Part 3 TAB New Zealand

54TAB New Zealand established

  1. This section establishes TAB New Zealand (TAB NZ).

  2. TAB NZ—

  3. is a body corporate; and
    1. is a legal entity separate from its members, office holders, and employees, and the Crown.
      1. TAB NZ has, both within and outside New Zealand,—

      2. full capacity to carry on or undertake any business or activity, do any act, or enter into any transaction; and
        1. subject to this section, full rights, powers, and privileges.
          1. TAB NZ must not enter into a partnering arrangement without written approval of the Minister.

          2. In deciding whether to grant approval under subsection (4), the Minister must take into account—

          3. the purposes of this Act; and
            1. the objectives and functions of TAB NZ.
              1. Subsection (3) applies subject to this Act, any other enactment, and the general law of New Zealand.
