127: Crown not liable for debts

You could also call this:

“The government usually doesn't pay racing groups' debts, but there are some exceptions”

The government doesn’t have to pay for any debts or money owed by TAB NZ, the Racing Integrity Board, or any of the committees or tribunals set up by the Racing Integrity Board. However, there are some cases where the government might still have to pay. These include:

If another law says the government has to pay.

If the government has promised to pay through a guarantee or indemnity under section 65ZD of the Public Finance Act 1989.

If someone has a good reason to take the government to court and wins against TAB NZ.

If someone has a good reason to take the government to court and wins against the Racing Integrity Board or its committees or tribunals.

If the government owes money to someone who the Reserve Bank of New Zealand owes money to.

In these special cases, the government might still have to pay, even though they don’t usually have to pay for the debts of these racing organisations.
