114: Minister must set rates of consumption charges

114Minister must set rates of consumption charges

  1. The Minister must set the rates of the consumption charges that offshore betting operators must pay—

  2. based on the prescribed percentage of the operator’s gross betting revenue; and
    1. in the prescribed manner.
      1. The Minister may set the rates by way of specified figures or methods of calculation.

      2. The Minister—

      3. must, at least once every 5 years, review the rates of consumption charges set under subsection (1); and
        1. may, if necessary, adjust those rates.
          1. Before setting or adjusting rates under this section, the Minister must consult the following:

          2. offshore betting operators liable to pay the charges:
            1. TAB NZ:
              1. each racing code:
                1. Sport and Recreation New Zealand:
                  1. relevant New Zealand national sporting organisations (as applicable).
                    1. An instrument setting rates under this section is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
