The administering body can lease a recreation reserve used for racecourse purposes. You can lease the whole reserve or just a part of it. The lease can be for a certain amount of rent and with certain conditions, as long as they are not inconsistent with the purposes of the reserve.

The administering body can lease the reserve to anyone for up to 7 years at a time. They can also lease it to a racing club for up to 33 years, but only with the Minister's consent and subject to certain conditions. The lease to a racing club can be renewed for a similar term.

The administering body has these leasing powers in addition to the powers given by sections 54 and 73.

67Leasing

  1. The administering body may from time to time lease the whole or any part of a recreation reserve set apart for racecourse purposes at such rent and on such conditions, not inconsistent with the purposes of the reserve, as it thinks reasonable—

  2. to any person for any term or terms of years not exceeding 7 years at any one time:
    1. with the prior consent of the Minister and subject to such conditions as he or she prescribes, to any racing club for a term of years not exceeding 33 years, with or without provision for renewal for 1 or more further similar terms.
      1. The powers of leasing conferred by this section are in addition to and not in substitution for the power of leasing conferred by sections 54 and 73.
