How Commissioner may enforce conditions of grant: Decisions not to recover debt, write-offs, and refunds
42Commissioner may decide not to recover debt in certain circumstances
The Commissioner may decide not to recover any debt due to the Commissioner under a grant of legal aid if—
- the enforcement of the debt would cause serious hardship to the aided person:
- the cost to the Commissioner of enforcing the debt is likely to exceed the amount of the debt that is likely to be repaid:
- the Commissioner considers that it would be just and equitable not to recover the debt.
The Commissioner may make a decision under subsection (1) at the time that legal aid is granted, or at any time after it is granted.
If the Commissioner decides not to recover a debt,—
- the debt must be treated as being written off for the purposes of section 43; and
- section 43(2) to (5) apply accordingly.
In subsection (1), serious hardship means significant financial difficulties that arise because of—
- the aided person's inability to meet minimum living expenses according to normal community standards; or
- the cost of medical treatment of an illness or injury of the aided person or the aided person's dependant; or
- a serious illness suffered by the aided person or the aided person's dependant.
