57Tribunal may direct Commissioner to reconsider

  1. The Tribunal may, instead of determining a review, give a direction to the Commissioner to reconsider all or any part of the decision to which the review relates.

  2. If the Tribunal gives a direction under subsection (1),—

  3. the Tribunal must give reasons for the direction and may set out the matters that the Commissioner must take into account when reconsidering the decision; and
    1. the Commissioner must reconsider the decision, taking into account the reasons for the direction and any matters set out by the Tribunal.
