66Delegation by chairperson of Tribunal
The chairperson of the Tribunal may delegate any of the chairperson's functions, duties, and powers to a member of the Tribunal who the chairperson is satisfied has the capability, skills, and experience to perform and exercise those functions, duties, and powers.
A delegation—
- must be in writing; and
- must be to a named person; and
- is revocable at any time, in writing; and
- does not prevent the performance or exercise of a function, duty, or power by the chairperson.
A person to whom any functions, duties, or powers are delegated may perform and exercise them in the same manner and with the same effect as if they had been conferred directly by this Act and not by delegation.
A person who appears to act under a delegation is presumed to be acting in accordance with its terms in the absence of evidence to the contrary.
A person to whom any functions, duties, or powers are delegated must be paid remuneration and expenses (if any) determined in accordance with clause 4 of Schedule 3 for work undertaken in that capacity.
