23Maximum grant
A grant of legal aid may specify a maximum grant, which is the amount of legal aid that is authorised under the grant.
A maximum grant may be expressed in any way. For example, it may refer to a total dollar amount, or a maximum number of hours, or a period within which the aid must be provided, or any combination of these or any other specifications.
When determining a maximum grant, the Commissioner may take into account any delay on the part of the applicant in applying for legal aid and the reason for the delay.
However, every grant of legal aid in respect of victims' claims proceedings (as defined in section 4(1)) must specify a maximum grant of the amount prescribed for the purposes of this subsection by regulations.
