When you get legal aid, it can say how much aid you can get, which is called a maximum grant. You can get a certain amount of money or a certain number of hours of help. The person deciding how much aid you get can think about if you waited too long to ask for help. If you are getting legal aid for a victims' claim, your maximum grant will be a set amount decided by regulations. This amount is decided according to section 4(1). You will get the amount that is prescribed for this type of claim. The Commissioner decides your maximum grant and can consider any delays in your application. They look at why you delayed applying for legal aid. Your maximum grant is the most aid you can get under your grant of legal aid.

23Maximum grant

  1. A grant of legal aid may specify a maximum grant, which is the amount of legal aid that is authorised under the grant.

  2. A maximum grant may be expressed in any way. For example, it may refer to a total dollar amount, or a maximum number of hours, or a period within which the aid must be provided, or any combination of these or any other specifications.

  3. When determining a maximum grant, the Commissioner may take into account any delay on the part of the applicant in applying for legal aid and the reason for the delay.

  4. However, every grant of legal aid in respect of victims' claims proceedings (as defined in section 4(1)) must specify a maximum grant of the amount prescribed for the purposes of this subsection by regulations.
