If you are a resident, you can still get a benefit. A benefit is defined in the Social Security Act 2018. When your benefit is being calculated, you are treated as if you are a patient in a hospital for more than 13 weeks.

You are treated as a hospital patient according to the Social Security Act 2018 or the New Zealand Superannuation and Retirement Income Act 2001. This means you can get a benefit even if you are a resident. Your benefit is calculated as if you have been in a hospital for a long time.

39Right to benefits

  1. A resident is not disentitled from obtaining a benefit (as defined in Schedule 2 of the Social Security Act 2018).

  2. For the purpose of calculating the benefit, the resident is taken to be a patient in a hospital (within the meaning of, as the case requires, sections 206 and 207 and Schedule 2 of that Act, or section 19(1) of the New Zealand Superannuation and Retirement Income Act 2001) for more than 13 weeks.
