If you are subject to a public protection order, a prison detention order, or a protective supervision order, and you are detained in a hospital under the Mental Health (Compulsory Assessment and Treatment) Act 1992, the order is suspended. This also happens if you are detained in a facility under the Intellectual Disability (Compulsory Care and Rehabilitation) Act 2003, or in a prison for another reason. The order stays suspended until you are no longer detained in the hospital, facility, or prison.

139Suspension of orders in certain cases

  1. This subsection applies if, while a person is subject to a public protection order, a prison detention order, or a protective supervision order, the person is detained—

  2. in a hospital under the Mental Health (Compulsory Assessment and Treatment) Act 1992; or
    1. in a facility under the Intellectual Disability (Compulsory Care and Rehabilitation) Act 2003; or
      1. in a prison otherwise than under this Act.
        1. If subsection (1) applies, the relevant order or orders specified in that subsection are suspended until the person is no longer detained in the hospital, facility, or prison.
