The Disputes Tribunal has the power to make decisions about certain disputes. You can take a dispute to the Tribunal if it is about an amount of money that is $60,000 or less. The Tribunal's decision can include ordering someone to pay money, but only up to $60,000. If you go to the Disputes Tribunal, the Tribunal can make an order that says someone must pay you money. The Tribunal can also decide that someone does not have to pay you money. However, the Tribunal's order cannot be about more than $60,000. If the Disputes Tribunal makes an order that is about more than $60,000, the order is not valid. The Tribunal gets its powers from the Disputes Tribunal Act 1988. The Tribunal can exercise its powers under sections 86 to 95 if the dispute is about $60,000 or less.

114Jurisdiction of Disputes Tribunal

  1. The Disputes Tribunal established under the Disputes Tribunal Act 1988 has jurisdiction to exercise the powers conferred by sections 86 to 95 if—

  2. the occasion for the exercise of the power arises in the course of any proceeding properly before the Tribunal; and
    1. the total amount for which an order of the Tribunal is sought does not exceed $60,000.
      1. An order of the Disputes Tribunal under section 95 may not—

      2. require a person to pay an amount exceeding $60,000:
        1. declare that a person is not liable to any other person for an amount exceeding $60,000:
          1. vest any property that exceeds $60,000 in value in any person:
            1. direct the transfer, assignment, or delivery of possession of any property that exceeds $60,000 in value.
              1. An order of the Disputes Tribunal that exceeds a restriction in subsection (2) is entirely of no effect.
