114: Jurisdiction of Disputes Tribunal

The Disputes Tribunal can make decisions about certain legal matters, but only if the case is properly brought to them and involves no more than $30,000. The Tribunal can use special powers described in sections 86 to 95 of the law.

When the Disputes Tribunal makes an order, they can’t tell someone to pay more than $30,000. They also can’t say that someone doesn’t have to pay more than $30,000 to another person. The Tribunal can’t give someone property worth more than $30,000 or tell someone to transfer property worth more than that amount.

114Jurisdiction of Disputes Tribunal

  1. The Disputes Tribunal established under the Disputes Tribunal Act 1988 has jurisdiction to exercise the powers conferred by sections 86 to 95 if—

  2. the occasion for the exercise of the power arises in the course of any proceeding properly before the Tribunal; and
    1. the total amount for which an order of the Tribunal is sought does not exceed $30,000.
      1. An order of the Disputes Tribunal under section 95 may not—

      2. require a person to pay an amount exceeding $30,000:
        1. declare that a person is not liable to any other person for an amount exceeding $30,000:
          1. vest any property that exceeds $30,000 in value in any person:
            1. direct the transfer, assignment, or delivery of possession of any property that exceeds $30,000 in value.
              1. An order of the Disputes Tribunal that exceeds a restriction in subsection (2) is entirely of no effect.
