49Power to make different provision for classes of matters

  1. This section applies to legislation that confers on a person a power to make secondary legislation or any other instrument with respect to particular matters (however the matters are described).

  2. The power includes a power—

  3. to make the secondary legislation or instrument with respect to some only of those matters or with respect to a particular class or particular classes of those matters; and
    1. to make different provision with respect to different matters or different classes of matters.
