When the Minister is choosing a person to be the Chairperson or a Deputy Chairperson of the Tribunal, they must think about what is said in section 101(2), as well as the person's experience in resolving disputes, their experience as a leader, and their ability to do the job. 99ACriteria and requirement for appointment of Chairperson and Deputy Chairperson

  1. In recommending a person for appointment as the Chairperson or a Deputy Chairperson of the Tribunal, the Minister must have regard not only to the matters stated in section 101(2) but also to the person's—

  2. experience in dispute resolution:
    1. experience as a Chairperson or a Deputy Chairperson and in other leadership roles:
      1. ability to perform the functions of the Chairperson or a Deputy Chairperson of the Tribunal.
        1. Every person appointed as the Chairperson or a Deputy Chairperson of the Tribunal must be a barrister or solicitor of the High Court of not less than 5 years' practice.
