This Act does not affect your right to take any other legal action. When a court decides how much money to give you, it must consider any other money you already got for the same reason. You can still take legal action under other laws. This Act does not allow you to take legal action for something that is only against the law under this Act, except as provided by this Act, and subject to subpart 5 of Part 2 of the Contract and Commercial Law Act 2017. This means you cannot sue someone just because they broke a rule in this Act. This Act does not change any other laws or rules that distinguish between New Zealand citizens and other people, or between British subjects and aliens. It also does not affect any government policies or practices that make these distinctions.

153Savings

  1. Nothing in this Act affects the right to bring any proceedings, whether civil or criminal, that may be brought other than under this Act, but, in assessing any damages to be awarded to or on behalf of any person under this Act or otherwise, a court must take account of any damages already awarded to or on behalf of that person in respect of the same cause of action.

  2. Subject to subpart 5 of Part 2 of the Contract and Commercial Law Act 2017, no proceedings, civil or criminal, shall lie against any person, except as provided by this Act, in respect of any act or omission which is unlawful by virtue only of any of the provisions of Part 2.

  3. Nothing in this Act shall affect any enactment or rule of law, or any policy or administrative practice of the Government of New Zealand, that—

    1. distinguishes between New Zealand citizens and other persons, or between British subjects or Commonwealth citizens and aliens.
