When you are a member of a statutory entity, you hold the position for a certain amount of time. If you are a member of a Crown agent or autonomous Crown entity, you hold office for 3 years or a shorter time stated in your appointment notice. If you are a member of an independent Crown entity, you hold office for 5 years or a shorter time stated in your appointment notice. You can be reappointed to the position. If your term of office ends, you keep being a member until you are reappointed, someone else is appointed to take your place, or you are told in writing that you will not be reappointed and no one will take your place at that time.

Your time as a member is also subject to what is said in section 45. You will keep doing the job even after your term ends, until one of the things mentioned happens. This means you do not automatically stop being a member when your term of office ends.

32Term of office of members

  1. A member of a statutory entity holds office for—

  2. 3 years or any shorter period stated in the notice of appointment, in the case of a member of a Crown agent or autonomous Crown entity; or
    1. 5 years or any shorter period stated in the notice of appointment, in the case of a member of an independent Crown entity.
      1. A member may be reappointed.

      2. A member continues in office despite the expiry of his or her term of office until—

      3. the member is reappointed; or
        1. the member's successor is appointed; or
          1. the appointor informs the member by written notice (with a copy to the entity) that the member is not to be reappointed and no successor is to be appointed at that time.
