190: Existing insurance cover

If you are a member, office holder, or employee of a statutory entity and you already have insurance cover, this section is about you. Your insurance cover is for any problems that might arise from something you did or did not do as a member, office holder, or employee. This insurance cover is not changed by the Crown Entities Act 2004.

If your insurance cover runs out, or if you get reappointed or re-employed, you can only get new insurance cover if the Crown Entities Act 2004 or the entity's Act allows it. You need to check these Acts to see if you can get new insurance cover. The insurance cover you already have is still valid.

You do not have to worry about the Crown Entities Act 2004 changing the insurance cover you already have, because it does not affect it.

190Existing insurance cover

  1. This section applies to a member, office holder, or employee of a statutory entity who has insurance cover at the commencement of this section in respect of any liability or costs arising from any act or omission as a member, office holder, or employee.

  2. The insurance cover is not affected by the enactment of this Act.

  3. However, if the insurance cover expires, or the member, office holder, or employee is reappointed or re-employed, the insurance can be renewed or effected only if permitted by this Act or the entity's Act.
