Crown Entities Act 2004

Establishment and governance of Crown entities - Statutory entities - Appointment, removal, and conditions of members

39: Removal of members of independent Crown entities

You could also call this:

"The Governor-General can sack a member of a Crown entity for a fair reason."

Illustration for Crown Entities Act 2004

The Governor-General can remove a member of an independent Crown entity from their job at any time if there is a good reason. You need to know that this happens when the responsible Minister advises the Governor-General after talking to the Attorney-General. The Governor-General makes this decision for a reason that is considered fair.

When a member is removed, they get a written notice telling them they are no longer in their job. The entity also gets a copy of this notice. The notice tells the member when they stop being in their job and why they are being removed.

The responsible Minister then tells the public about the removal by putting it in the Gazette as soon as they can after the notice is given.
