49: Proceedings before Tribunal

The Tribunal can decide how it wants to run its procedures. However, it must follow the rules set out in this Act, any regulations made under this Act, and any practice notes issued under clause 12 of the Schedule.

The Tribunal usually looks at written information to make decisions about complaints or matters. This means they don’t usually have people come in to talk about the issue in person.

Even though the Tribunal usually looks at written information, they can choose to do two extra things if they think it’s necessary:

  1. They can ask for more information from anyone about a complaint or matter.
  2. They can ask someone to come and talk to them in person to explain something about a complaint or matter.

The Tribunal gets to decide if they want to do these extra things. It’s completely up to them.

49Proceedings before Tribunal

  1. The Tribunal may regulate its procedures as it thinks fit.

  2. Subsection (1) is subject to this Act, any regulations made under this Act, and any practice notes issued under clause 12 of the Schedule.

  3. Matters or complaints must be heard on the papers.

  4. Despite subsection (3), the Tribunal may, if it thinks fit in its absolute discretion,—

  5. request further information from any person in relation to a complaint or matter:
    1. request that any person appear before the Tribunal to make a statement or an explanation in relation to a complaint or matter.
