84: Determination of appeal

When you appeal a decision made by the Registrar or the Tribunal, the District Court will decide what happens. The court can agree with the original decision, change it, or completely reverse it.

Once the District Court makes its decision on your appeal, that decision is final. This means you can’t appeal it further in the same way.

However, you still have two other options if you’re not happy with the District Court’s decision. You can ask for a judicial review, which is a special kind of legal process. You can also appeal to the High Court, but only if your appeal is about a question of law. This means you think the District Court made a mistake about what the law says or how it works.

84Determination of appeal

  1. In determining an appeal, the District Court may confirm, vary, or reverse the decision of the Registrar or the Tribunal.

  2. The District Court's decision in the determination of an appeal is final.

  3. To avoid doubt, nothing in this section affects the right of any person—

  4. to apply, in accordance with law, for judicial review; or
    1. to appeal to the High Court on a question of law under section 85.
