92National advisory committee on health services ethics

  1. The Minister must, by written notice, appoint a national advisory committee for the purpose of obtaining advice on ethical issues of national significance in respect of any health and disability matters (including research and services).

  2. The committee must determine nationally consistent ethical standards across the health sector and provide scrutiny for national health research and services.

  3. For the purpose of obtaining advice on specific ethical issues of national, regional, or public significance in respect of any health and disability matters, the Minister may, by written notice, appoint any 1 or more of the following committees:

  4. 1 or more ministerial committees:
    1. the ethics committee of the Health Research Council established under section 24 of the Health Research Council Act 1990
      1. to consider matters specified by the Minister and to report to the Minister or a person specified by the Minister.

      2. Before a committee appointed under subsection (1) or (3) gives advice, the committee must consult with any members of the public, persons involved in the funding or provision of services, and other persons that the committee considers appropriate.

      3. As soon as practicable after giving a notice under subsection (1) or (3), the Minister must present a copy of the notice to the House of Representatives.

      4. A committee appointed under this section must, at least once a year, deliver to the Minister a report setting out its activities and summarising its advice on the matters referred to it under this section.

      5. As soon as practicable after receiving a report under subsection (6), the Minister must present a copy of the report to the House of Representatives.
