37: Requirement where employee wishes to begin primary carer leave early

If you want to take parental leave and start your primary carer leave earlier than planned, you need to follow these rules:

You must have already told your employer that you want to take parental leave. You also need to let your employer know that you want to start your primary carer leave early.

When you decide to start your primary carer leave early, you must tell your employer in writing. You have to do this at least 21 days before the day you want your primary carer leave to begin.

37Requirement where employee wishes to begin primary carer leave early

  1. This section applies to an employee who—

  2. has given notice that the employee wishes to take parental leave under this Act; and
    1. intends to exercise the option conferred by section 11 by beginning his or her primary carer leave early.
      1. The employee must give his or her employer not less than 21 days’ notice in writing of the day on which the employee wishes his or her primary carer leave to begin.
