If you are a COVID-19 response worker, your parental leave payments work a bit differently. You will keep getting payments until one of two things happens, whichever comes first:

  1. You have received all the parental leave payments you are entitled to under the law. The amount you can get is set out in other parts of the law.

  2. You go back to work permanently, either as an employee or if you work for yourself. You need to tell the government when you do this.

Remember, you can’t keep getting payments after either of these things happen. The payments will stop on the day you’ve received all your entitled payments or on the day you go back to work permanently.

30JIEnd of parental leave payments

  1. Section 71L(1) does not apply to a COVID-19 response worker and this section applies instead.

  2. A parental leave payment is payable to the worker in respect of a child for a period that ends on the earlier of—

  3. the date on which the worker has received all the parental leave payments to which the worker is entitled under section 71D and section 71J (as that section applies to a COVID-19 response worker in accordance with section 30JK); and
    1. the date on which the worker permanently returns to work as an employee or a self-employed person (as notified under section 71U).
