Parental Leave and Employment Protection Act 1987

Remedies available to employees

65: Remedies

You could also call this:

“What happens if your employer breaks the rules about parental leave”

If your employer breaks any of the rules in this Act, or if a decision is made about this Act, there are things that can be done to help you. If it’s found that your employer did break the rules, one or more of these things might happen:

You might get your old job back, or a job that’s just as good.

You might get some or all of the money you would have earned if you hadn’t lost your job.

Your employer might have to pay you some extra money to make up for what happened.

These are ways to make things right if your employer doesn’t follow the rules about parental leave and employment protection.
