You can get a parental leave payment for up to 26 weeks in one continuous period. If you share part of your entitlement with someone else, you can each get a payment for one continuous period, but the two periods together can’t be more than 26 weeks.

If you become entitled to a preterm baby payment while you’re already getting a parental leave payment, there’s a special rule that applies. This rule is explained in another part of the law.

71JDuration of parental leave payment

  1. A parental leave payment is payable—

  2. for 1 continuous period not exceeding 26 weeks; or
    1. if part of the entitlement is transferred under section 71E, for 1 continuous period per person, so long as the 2 continuous periods do not together exceed 26 weeks.
      1. This section is subject to section 71DA(5)(b) (which applies to a person who becomes entitled to a preterm baby payment while receiving a parental leave payment).
