When the Auckland Council makes decisions, it must decide who is in charge of making those decisions. You need to know that the governing body must allocate decision-making responsibility for any non-regulatory activity to either the governing body or the local boards. They must do this in accordance with certain principles and after considering the views of each local board.

The principles say that local boards should make decisions about non-regulatory activities unless it is better for the governing body to make the decision. You will see that the governing body should make the decision if it affects the whole of Auckland, or if it needs to be aligned with other decisions the governing body makes. The governing body should also make the decision if a consistent approach across Auckland is more beneficial than making different decisions for each local board area.

The Auckland Council must consider the views of each local board when allocating decision-making responsibilities. This means that local boards get to have a say in who makes the decisions. The governing body must then make its decision based on the principles and the views of the local boards.

Decision making

17Principles for allocation of decision-making responsibilities of Auckland Council

  1. Decision-making responsibility for any non-regulatory activity of the Auckland Council must be allocated by the governing body—

  2. to either the governing body or the local boards; and
    1. in accordance with the principles set out in subsection (2); and
      1. after considering the views and preferences expressed by each local board.
        1. The principles are—

        2. decision-making responsibility for a non-regulatory activity of the Auckland Council should be exercised by its local boards unless paragraph (b) applies:
          1. decision-making responsibility for a non-regulatory activity of the Auckland Council should be exercised by its governing body if the nature of the activity is such that decision making on an Auckland-wide basis will better promote the well-being of the communities across Auckland because—
            1. the impact of the decision will extend beyond a single local board area; or
              1. effective decision making will require alignment or integration with other decisions that are the responsibility of the governing body; or
                1. the benefits of a consistent or co-ordinated approach across Auckland will outweigh the benefits of reflecting the diverse needs and preferences of the communities within each local board area.
