10: Application of Act to ships

“Ships covered by this law: New Zealand ships worldwide and foreign ships in NZ waters”

This law applies to all New Zealand ships, no matter where they are in the world. It also applies to foreign ships that are rented by New Zealand companies when they are in New Zealand waters.

If someone breaks this law on a ship outside of New Zealand, they can still be punished for it. This is true even if the ship is not in New Zealand at the time.

This law doesn’t change how it applies to the Armed Forces, which is explained in section 7. It also doesn’t change how it applies in the exclusive economic zone or on the continental shelf, which is explained in section 11.

Application of Act

10Application of Act to ships

  1. This Act applies to a New Zealand ship wherever it may be.

  2. This Act applies to a foreign ship on demise charter to a New Zealand-based operator when it is operating in New Zealand.

  3. To avoid doubt, where this Act applies outside New Zealand, the provisions relating to offences apply even if an act or omission that constitutes an offence occurs in respect of a ship outside New Zealand.

  4. This section does not limit or affect—

  5. section 7 (which relates to the application of this Act to the Armed Forces); or
    1. section 11 (which relates to the application of this Act in the exclusive economic zone or in or on the continental shelf).
