104: Extension of time for compliance with improvement notices

If you get an improvement notice, you need to know about this rule. It’s about getting more time to follow the notice.

An inspector can give you more time to do what the notice says. They do this by writing to you. But they can only give you more time if the original time hasn’t run out yet.

The time you have to follow the notice is called the ‘compliance period’. This includes both the time first given in the notice and any extra time the inspector gives you later.

104Extension of time for compliance with improvement notices

  1. This section applies if a person has been issued with an improvement notice.

  2. An inspector may, by written notice given to the person, extend the compliance period for the improvement notice.

  3. However, the inspector may extend the compliance period only if the period has not ended.

  4. In this section, compliance period

  5. means the period stated in the improvement notice under section 103(1); and
    1. includes any extension of that period under this section.
