Health and Safety at Work Act 2015

Enforcement and other matters - Inspectors and health and safety medical practitioners - Inspectors

174: Continuation of powers of entry and inspection without search warrants

You could also call this:

“Inspectors can continue entry and inspection if they find evidence of non-compliance”

If an inspector is using their powers to enter and inspect a place, as allowed by section 168 or section 169, they might find evidence that someone is not following health and safety laws. In this case, the inspector can keep using their powers to enter and inspect without needing to get a search warrant. Usually, they would need a search warrant from section 173 to keep looking around, but in this situation, they don’t have to stop and get one. They can just keep on using their powers from section 168 or 169.
