195: Health and Safety at Work Strategy

The Minister must create and share a plan called the Health and Safety at Work Strategy. This plan explains how the government wants to make work safer and healthier for workers. The Minister and WorkSafe must work together to make this plan.

The Minister should try to share the first plan within two years after this law starts. The Minister can change or make a new plan at any time.

The plan needs to do two things. First, it must point out any big problems in how work health and safety is managed, and how to fix these problems. Second, it must think about what ACC wants to do to stop injuries.

When making the plan, the Minister must talk to government agencies that make rules. They also need to talk to people or groups who care about work health and safety in New Zealand.

After the plan is ready, the Minister must share it with everyone and give it to the House of Representatives as soon as they can. This also applies if they change the plan or make a new one.

195Health and Safety at Work Strategy

  1. The Minister must publish a strategy, called the Health and Safety at Work Strategy, that sets out the Government's overall direction in improving the health and safety of workers.

  2. The strategy must be developed jointly with WorkSafe.

  3. The Minister must make reasonable efforts to publish the first strategy within 24 months after the commencement of this section.

  4. The Minister may amend or replace the strategy at any time.

  5. The strategy must—

  6. identify any significant issues relating to capacity or capability in the work health and safety system and any plan for addressing the issues; and
    1. take account of ACC's injury prevention priorities.
      1. The strategy, or amendments to it or replacement of it, must be developed by a process that involves consultation—

      2. with regulatory agencies; and
        1. with other persons who have an interest in work health and safety in New Zealand or with organisations representing those persons.
          1. The Minister must make publicly available, and present to the House of Representatives, a copy of any strategy, amendment, or replacement as soon as practicable after the strategy, amendment, or replacement has been published or made under this section.
