34: PCBU must consult other PCBUs with same duty

If more than one PCBU (person conducting a business or undertaking) has a duty about the same matter under this Act, they must work together. You need to talk to, help, and plan activities with all other PCBUs who have the same duty. You should do this as much as you reasonably can.

If you don’t do this, you’re breaking the law. This is called an offence. If you’re found guilty, you can be punished. If you’re an individual, you might have to pay a fine of up to $20,000. If you’re not an individual (like a company), you might have to pay a fine of up to $100,000.

34PCBU must consult other PCBUs with same duty

  1. If more than 1 PCBU has a duty in relation to the same matter imposed by or under this Act, each PCBU with the duty must, so far as is reasonably practicable, consult, co-operate with, and co-ordinate activities with all other PCBUs who have a duty in relation to the same matter.

  2. A person who contravenes subsection (1) commits an offence and is liable on conviction,—

  3. for an individual, to a fine not exceeding $20,000:
    1. for any other person, to a fine not exceeding $100,000.
