The Act covers you if you’re doing activities that are controlled by two other laws: the Exclusive Economic Zone and Continental Shelf (Environmental Effects) Act 2012 or the Crown Minerals Act 1991.

The Act also applies to you if you’re on an aircraft or ship travelling between New Zealand and these work areas. This includes foreign ships too.

The ‘continental shelf’ is defined in another law called the Continental Shelf Act 1964. The ‘exclusive economic zone’ is an area of sea around New Zealand that’s defined in the Territorial Sea, Contiguous Zone, and Exclusive Economic Zone Act 1977.

Application of Act

11Application of Act in exclusive economic zone and in or on continental shelf

  1. This Act applies to—

  2. a workplace in the exclusive economic zone or in or on the continental shelf if an activity that is regulated under the Exclusive Economic Zone and Continental Shelf (Environmental Effects) Act 2012 or the Crown Minerals Act 1991 is carried out at the workplace; and
    1. any aircraft or ship (including a foreign ship) operating between New Zealand and the workplace in connection with an activity to which paragraph (a) applies.
      1. In this section,—

        continental shelf has the same meaning as in section 2(1) of the Continental Shelf Act 1964

          exclusive economic zone means the exclusive economic zone of New Zealand as defined in section 9 of the Territorial Sea, Contiguous Zone, and Exclusive Economic Zone Act 1977.
