Health and Safety at Work Act 2015

Enforcement and other matters - Criminal proceedings

141: Meaning of enforcement action

You could also call this:

“What counts as taking action to enforce this law”

In this part of the law, ‘enforcement action’ means different things depending on who is taking the action. If the regulator (the person or group in charge of enforcing the law) is taking action, it means they are either filing a formal charge in court or giving out a ticket for breaking a rule in this law. If anyone else is taking action, it means they are filing a formal charge in court for someone breaking a rule in this law. When the regulator files a charge or when someone else files a charge, they do this under section 14 of the Criminal Procedure Act 2011. This explanation of ‘enforcement action’ applies to this part of the law unless the surrounding text suggests it should mean something different.
