If you are making an appeal under this part of the law, you will go to a court to have your case heard again. The court you go to is called the first appeal court. You will go to the District Court if you are appealing a decision made by Community Magistrates or Justices of the Peace. You will go to the High Court if you are appealing a decision made by a District Court Judge.

If you are appealing any other type of decision, you can go to either the Court of Appeal or the Supreme Court. The law says which court you can go to, depending on who made the original decision. You can find more information about the courts and the law by looking at the District Court Act 2016.

284First appeal courts

  1. The first appeal court for an appeal under this subpart is—

  2. the District Court presided over by a District Court Judge, if the appeal is against a decision of the District Court presided over by 1 or more Community Magistrates or 1 or more Justices of the Peace; or
    1. the High Court, if the appeal is against a decision of the District Court presided over by a District Court Judge; or
      1. either the Court of Appeal or the Supreme Court, in any other case.
