Criminal Procedure Act 2011

Procedure before trial - Case management

58: Court may give directions about case management procedure

You could also call this:

"The court can make a plan to help a case run smoothly and fairly."

Illustration for Criminal Procedure Act 2011

The court can give directions about how a case is managed if it thinks it will help resolve the issue or if it is fair. You can think of this like a plan to make sure everything runs smoothly. The court can decide to do this on its own or because the prosecutor or defendant asked it to.

The court can choose to ignore some of the rules in sections 54 to 57 if it thinks that will help. It can also give other directions about how to manage the case.

The court's decision can be made without anyone asking, or the prosecutor or defendant can ask the court to make a decision about how the case is managed.
