If you are charged with a category 2, 3, or 4 offence and you plead not guilty, the judicial officer must stop the court case for now. This is so the case can be looked at again, which is called a case review. A Registrar can also make this decision for category 2 or 3 offences.

54Adjournment for case review

  1. If the defendant pleads not guilty to a charge for a category 2, 3, or 4 offence, a judicial officer must adjourn the proceeding for case review.

  2. A Registrar may exercise the power under subsection (1) to adjourn a proceeding for a category 2 or 3 offence.
