403A: Transitional provision regarding effect of appeal on sentence of home detention

Illustration for Criminal Procedure Act 2011

If you are sentenced to home detention and someone appeals the decision, the sentence does not automatically stop. The appeal court must say the sentence should be stopped for it to be suspended. You can apply for bail while waiting for the appeal to be heard.

When you apply for bail, the rules from the Bail Act 2000 apply, but with some changes. Some parts of the Bail Act 2000, like sections 14, 53, 54, 55, 58, and 60, have special rules for your situation. The Crimes Act 1961 and the Summary Proceedings Act 1957 do not apply in this case.
