If you are found guilty of a crime and you appeal, something might happen to a registration order made about you. A registration order is made under section 9 of the Child Protection (Child Sex Offender Government Agency Registration) Act 2016. When you appeal, the time you have to report as part of the order stops on the day you file your appeal. You have to wait and see what happens with your appeal. The time you have to report starts again when your appeal is dismissed, or when you are not allowed to appeal, or when your appeal is decided and you are still guilty.

348AHow appeal affects registration orders

  1. On a conviction to which an appeal relates where the court appealed from made a registration order under section 9 of the Child Protection (Child Sex Offender Government Agency Registration) Act 2016 in respect of the convicted person, the reporting period ceases to run on the day on which notice of appeal or of application for leave to appeal is filed.

  2. The reporting period resumes from the date on which—

  3. the appeal is dismissed or abandoned; or
    1. leave to appeal is refused; or
      1. the appeal is decided, if neither the registration order nor the conviction on which it was imposed is set aside.
