96Maintenance order in favour of mentally disordered person

  1. Where a maintenance order is made by a court for the payment of a periodical sum in favour of a person who at the date of the making of the order is receiving care and treatment in a hospital as defined in section 2 of the Mental Health (Compulsory Assessment and Treatment) Act 1992, the order may provide for—

  2. the payment of a periodical sum in respect of periods while that person is receiving care and treatment in such a hospital; and
    1. the payment of a different periodical sum in respect of periods while that person is not receiving care and treatment in such a hospital.
