When you apply for maintenance and you live in a country that has an agreement with New Zealand, the Registrar of the District Court will look at your application. If your application is about someone other than a child, or if it is made under certain sections like sections 78 to 81, the Registrar will deal with it as if you had applied for a maintenance order directly to the court under Part 6. If your application is about the maintenance of a child, the Registrar will deal with it according to sections 145B to 145I, but only if the Registrar gets the application from the Secretary and it is subject to section 145J.

145ATreatment of applications for maintenance by applicants residing in Convention countries

  1. Where a Registrar of the District Court receives from the Secretary an application under this section, the Registrar shall (subject to section 145J),—

  2. in the case of an application in respect of the maintenance of any person other than a child of the respondent, or an application made pursuant to any of sections 78 to 81, deal with the application in all respects as if it were an application for a maintenance order made to the court under Part 6, and that Part shall apply accordingly:
    1. in the case of an application in respect of the maintenance of any child of the respondent, deal with the application in accordance with sections 145B to 145I.
