If you make a complaint about a registered valuer, the Board will look into it. The Board can take action if it is satisfied with the complaint as referred to in section 35. You can think of the Board like a group of people who help keep valuers accountable. The Board can decide to do one or more things to the valuer, such as tell them off, make them pay a fine of up to $20,000, or make them do some extra training. The Board can also suspend the valuer's registration for up to 12 months or remove their name from the register. This means the valuer can no longer work as a valuer. If the Board makes a decision, it must be in writing and explain why they made that decision. The Board cannot fine a valuer for something they have already been convicted of. If the Board decides to remove a valuer's name from the register, the Registrar must do so.

41Disciplinary powers

  1. After an inquiry into a complaint against a registered valuer, the Board may decide to do 1 or more of the following if it is satisfied as referred to in section 35:

  2. censure the valuer:
    1. order the valuer to pay a penalty not exceeding $20,000:
      1. order the valuer to do 1 or more of the following things within the period and in the manner specified in the order:
        1. pass an examination:
          1. complete a competence programme or training:
            1. attend a course of instruction:
            2. order that the valuer’s registration be suspended for a period not exceeding 12 months:
              1. direct that the valuer’s name be removed from the register.
                1. A decision under this section must—

                2. be in writing; and
                  1. contain a statement of the reasons on which it is based.
                    1. The Board must not impose a penalty under subsection (1)(b) for an act or omission that constitutes an offence if the valuer has been convicted of the offence.

                    2. The Registrar must remove a person’s name from the register if the Board directs the Registrar to do so under this section.
