41BSuspension after failure to comply with order to pass examination, etc

  1. If the Board makes an order under section 41(1)(c) and the person concerned fails to comply with the order, the Board may order that the person’s registration be suspended for a period not exceeding 12 months.

  2. The Board may not make an order under this section unless it has first—

  3. informed the person concerned why it may act in that manner; and
    1. given the person or the person’s representative an opportunity to make written submissions and to be heard on the matter.
