45BBoard may delegate disciplinary powers to committee

  1. The Board may, by resolution, delegate any of its functions, powers, or duties under this subpart in relation to a particular complaint to a committee that consists of the following persons (who must be named in the resolution):

  2. 2 or more members of the Board:
    1. 1 other person.
      1. The committee may, unless the delegation provides otherwise, perform or exercise the function, power, or duty in the same manner, subject to the same restrictions, and with the same effect as if the committee were the Board.

      2. A committee that purports to perform or exercise a function, power, or duty under a delegation—

      3. is, in the absence of proof to the contrary, presumed to do so in accordance with the terms of that delegation; and
        1. must produce evidence of its authority to do so, if reasonably requested to do so.
          1. No delegation under this section—

          2. affects or prevents the performance or exercise of any function, power, or duty by the Board; or
            1. affects the responsibility of the Board for the actions of any committee acting under the delegation; or
              1. is affected by any change in the membership of the Board.
                1. A delegation may be revoked at will by resolution of the Board.

                2. Except as otherwise provided under a resolution of the Board, the members of a committee may regulate their own procedure.
