Transfer of registration of companies to other jurisdictions
353Company to give public notice
A company must not apply to be removed from the New Zealand register under section 351 unless—
- the company gives public notice—
- stating that it intends, after the date specified in the notice, which must not be less than 20 working days after the date of the notice, to apply under section 351 for the company to be removed from the New Zealand register in connection with the company becoming incorporated under the law in force in, or in any part of, another country; and
- specifying the country or part of the country under the law of which it is proposed that the company will become incorporated; and
- stating that it intends, after the date specified in the notice, which must not be less than 20 working days after the date of the notice, to apply under section 351 for the company to be removed from the New Zealand register in connection with the company becoming incorporated under the law in force in, or in any part of, another country; and
- the application is made after that date.
