You are part of a group of people called officials if you are a member of the board, a member of the MPC, the Governor, or an office holder or employee of the Bank. This includes people working for the Bank as contractors or secondees. You are also an official if you used to be in one of these roles. You are considered an official for the purposes of sections 105 and 105A of the Crimes Act 1961. This does not change the meaning of official in section 99 of the Crimes Act 1961. 200Members, Governor, office holders, and employees are officials

  1. This section applies to members of the board, members of the MPC, the Governor, and office holders and employees of the Bank or of a wholly-owned subsidiary of the Bank.

  2. In this section, individuals working for the Bank as contractors or secondees in relation to a function, duty, or power of the Bank are to be treated as if they are employees.

  3. This section also applies to a person who was formerly a person described in subsection (1) or (2) in respect of any acts or omissions or decisions made—

  4. while that person was a person described in subsection (1) or (2); and
    1. after the commencement of this subsection.

      1. A person to whom this section applies is an official for the purposes of sections 105 and 105A of the Crimes Act 1961.

      2. This section does not limit the meaning of official in section 99 of the Crimes Act 1961.
