166Infringement offence to fail to comply with notice

  1. An operator commits an infringement offence if it fails to comply with a notice under section 164 or 165, or any requirements of the Bank under either of those sections.

  2. An operator that commits the infringement offence is liable to—

  3. an infringement fee of—
    1. $1,000 in the case of an individual; or
      1. $3,000 in any other case; or
      2. a fine imposed by a court not exceeding—
        1. $3,000 in the case of an individual; or
          1. $9,000 in any other case.
