14H: Determining area-based maximum levels of fishing-related mortality

When the Minister sets area-based limits for fishing, you need to know they can only do this for certain groups of threatened species. These groups must be separate from others because of where they live or their genetics. The Minister can also set these limits for areas that are already used to manage fisheries under the Fisheries Act 1996. When setting these limits, the Minister must make sure the fishing does not reduce the population size or threaten the species' ability to reproduce.

14HDetermining area-based maximum levels of fishing-related mortality

  1. Area-based limits set under section 14F(1)(g) shall be set only—

  2. for populations of threatened species that are geographically or genetically discrete; and
    1. for areas corresponding to areas having effect under the Fisheries Act 1996 as fisheries management areas or quota management areas.
      1. In setting any area-based limit for a threatened species under section 14F(1)(g), the Minister shall determine a level of fishing-related mortality for a discrete population referred to in subsection (1) which should neither cause a net reduction in the size of the population nor seriously threaten the reproductive capacity of that population.
