6: Certain wildlife may be hunted subject to conditions imposed by the Minister

The Minister can decide that some wildlife can be hunted, but only if you follow certain rules. You can find out which wildlife is allowed to be hunted by looking at the Schedule 3 list. The Minister can set rules about who can hunt, how many animals you can hunt, where you can hunt, and when you can hunt.

The Minister can also decide how you are allowed to hunt the wildlife, and can even ban certain methods. If you hunt or kill wildlife without following these rules, you can get in trouble with the law and have to pay a penalty, which is explained in section 67F(3).

When the Minister makes these rules, they have to follow certain steps, which are explained in the Legislation Act 2019.

6Certain wildlife may be hunted subject to conditions imposed by the Minister

  1. The Minister may from time to time in his discretion, by notice, declare that any wildlife for the time being specified in Schedule 3 may be hunted or killed or had in possession subject to such conditions as he prescribes, and any such wildlife may be hunted or killed or had in possession accordingly.

  2. Without limiting the general power to prescribe conditions conferred by subsection (1), the Minister may prescribe under that subsection any of the following conditions:

  3. prescribing the persons or classes of persons who may hunt or kill or be in possession of any such wildlife:
    1. restricting the numbers of any such wildlife that may be hunted or killed or had in possession by any one person in any one day:
      1. prescribing the parts of New Zealand in which any such wildlife may be hunted or killed or had in possession:
        1. prescribing the times of day or the periods of the year during which any such wildlife may be hunted or killed or had in possession:
          1. prescribing the methods by which any such wildlife may be hunted or killed, or prohibiting the use of any specified method.
            1. Every person who hunts, kills, or has in his or her possession any wildlife to which any notice under subsection (1) refers, otherwise than in accordance with any conditions prescribed by the Minister under this section, commits an offence against this Act and is liable on conviction to the penalty set out in section 67F(3).
