63A: Taking of absolutely or partially protected marine wildlife

If you hunt or kill absolutely or partially protected marine wildlife without permission, you are breaking the law. You will be liable for a penalty as stated in section 67(fa) if you are found guilty. This also applies if you buy, process, or sell these protected animals, or if you disturb or destroy their nests. You are not allowed to have absolutely or partially protected marine wildlife in your possession without lawful authority. If you rob, disturb, or destroy the nest of any absolutely or partially protected marine wildlife, you are committing an offence against this Act.

63ATaking of absolutely or partially protected marine wildlife

  1. Every person commits an offence against this Act and is liable on conviction to the penalty set out in section 67(fa) who without lawful authority (the proof of which shall be on the person charged)—

  2. hunts or kills any absolutely or partially protected marine wildlife; or
    1. buys or processes for sale or sells or otherwise disposes of or has in his or her possession any absolutely or partially protected marine wildlife or any part thereof; or
      1. robs, disturbs, or destroys, or has in his or her possession the nest of any absolutely or partially protected marine wildlife.
