66: Continuing offence after being required to desist

You could also call this:

"Breaking a wildlife rule after being told to stop"

If you break a rule in the Wildlife Act 1953, or any rules made under this Act, an authorised person can tell you to stop. This person is defined in section 61 of the Act. You must stop doing what you are doing straight away.

If you keep doing what you are not supposed to do after being told to stop, you commit another offence. You can be punished for this and the penalty is stated in section 67F(5) of the Act. You will be liable for this penalty if you are found guilty.

66Continuing offence after being required to desist

  1. Where any person is found offending against this Act or against any regulations or notification under or pursuant to this Act, it shall be lawful for any authorised person as defined in subsection (3) of section 61 to require the offender forthwith to desist from the offence.

  2. Every person who, after being required to desist from offending under subsection (1), wilfully continues the offence commits a further offence against this Act and is liable on conviction to the penalty set out in section 67F(5).
