70F: Failure to produce licence on demand

If you are in an area where wildlife is usually found and you have something that can be used to hunt or kill wildlife, like a firearm or a trap, you need to have a licence. You must have this licence if it is required by the Wildlife Act 1953. If someone who is allowed to ask, called an authorised person, demands to see your licence, you must show it to them. You can find out what an authorised person is by looking at section 61(3). If you do not show your licence when you are asked, you will commit an infringement offence.

70FFailure to produce licence on demand

  1. This section applies to a person if—

  2. the person is found, in any area where any species of wildlife is usually prevalent, in possession of or in control of a firearm, net, trap, decoy, or other instrument or device capable of being used for the purpose of hunting or killing the relevant species of wildlife; and
    1. a licence to hunt or kill the relevant species of wildlife is required under this Act; and
      1. an authorised person demands that the person produce the person’s licence.
        1. A person to whom this section applies must produce the person’s licence to the authorised person.

        2. A person who fails to comply with this section commits an infringement offence.

        3. In this section, authorised person has the meaning given in section 61(3).
